So the company I work for didn’t pass for Cafeteria Benefits Plan testing which means they have to make our pretax benefits now taxable for highly compensated employees. I only use them for traditional FSA and have already max out the reimbursement for this year. They told us that I m no longer eligible for pretax FSA and they are returning all the money that I have already contributed post tax and that the vendor that process the claims, will be send an "Overpayment Letter" for those expenses and I will need to pay the claims vendor back. The amount is quite substantial-$1500.
Am I legally required to pay back this amount. I m thinking that the company have no legal recourse to get the money back but they are just trying to send a letter hoping we will pay it back. Looking for some expertise here .
