My mother passed leaving an irrevocable trust - containing 2+M in stock and 2 properties worth 550k.
Beneficiaries are 3 sons - me and my 2 brothers. I am also the trustee. My mother had always intended to leave one house to my oldest brother with the remaining assets split evenly. This would end up giving my oldest brother appx 190k more than the other boys. The trust just indicates assets split evenly.
All boys (beneficiaries) are agreeable to this slightly uneven split. Can this be done? Should we sign something indicating our agreement?
